Religious Discrimination

 

       
Religious discrimination is illegal under both state and federal laws. Under the law employers are required to honor all religious requests of employees, unless the requests cause an “undue hardship” for the employer.  There are limited exceptions to this rule (such as religious schools, which are allowed to hire based on religious affiliation).

·        Additionally employers are not permitted to discrimination against employees on the basis of religion for the purposes of hiring, firing, promotion, transfer, job training or apprenticeship decisions.  Nor are employers or other employees permitted to harass co-workers on the basis of religion.

·        To raise a claim for religious discrimination with the state, you must file a complaint with the appropriate state administrative agency within 180 days after the alleged act of discrimination.  To file a violation of the federal law, you must file a complaint with the Equal Employment Opportunity Commission (“EEOC”).   If your employer violated both state and federal law, you must timely file your complaints with the state administrative agency, which will also send a copy to the EEOC.
